These Terms & Conditions apply to advertising services offered through Potter Service by Bow, including but not limited to in-car tablet ads, website listings, printed brochures, and vehicle advertising.

By purchasing or submitting payment for advertising services, the advertiser (“Client”) agrees to these Terms & Conditions. Potter Service by Bow (“Bow”, “we”, “our”) reserves the right to update or modify these terms at any time.

2. Payment Terms

  • All advertising must be paid in full in advance before placement begins.
  • Payments are non-refundable once service has started.
  • Failure to pay may result in suspension or removal of advertising.
  • Returned, reversed, or disputed payments may result in immediate removal of service.

3. Pricing & Rate Changes

  • All prices are subject to change at any time.
  • Reasonable notice will generally be provided before pricing changes take effect.
  • Notice may be provided by email, phone, invoice, or website notice.
  • Continued use of services after notice means acceptance of updated pricing.
  • Promotional or discounted pricing may be limited, changed, or discontinued at any time.

4. Advertising Start & Duration

  • Advertising begins only after payment is received and ad materials are approved.
  • Website and tablet ads are billed monthly unless otherwise stated.
  • Brochure ads include the stated placement period at the time of sale.
  • Vehicle magnet advertising includes setup terms as described in the offer.
  • Delays caused by missing materials, incomplete information, or approval issues may delay start dates.

5. Ad Content & Approval

  • All advertisements are subject to approval before being displayed.
  • Bow may reject, remove, or decline any ad for any lawful reason.
  • Ads that are false, misleading, offensive, illegal, or inappropriate may be removed without refund.
  • The Client is responsible for all text, offers, claims, images, logos, and submitted materials.
  • The Client confirms they have permission to use all submitted content.

6. Placement, Rotation & Availability

  • Ad placement may vary depending on layout, availability, and operational needs.
  • Tablet ads rotate and are not guaranteed continuous or equal display time unless specifically agreed.
  • Website layout and placement may change as the site is updated.
  • Brochure placement may vary by category, spacing, and design needs.
  • Vehicle ad visibility may vary due to weather, traffic, vehicle use, cleaning, or maintenance.

7. No Guarantee of Results

  • Advertising provides exposure only and does not guarantee sales, calls, bookings, leads, or customer traffic.
  • Results may vary based on season, location, demand, tourism levels, pricing, and business type.
  • Bow makes no promise regarding return on investment or performance.

8. Service Changes, Downtime & Interruptions

  • Bow may update, change, improve, pause, or discontinue portions of the service at any time.
  • This may include website updates, ad system changes, brochure redesigns, or temporary downtime.
  • Uninterrupted service is not guaranteed.
  • Reasonable efforts will be made to maintain advertiser value when changes occur.

9. Cancellation Policy

  • Clients may request cancellation before the next billing cycle.
  • No refunds will be provided for active billing periods or completed placements.
  • Brochure placements already printed, designed, or distributed are non-refundable.
  • Setup fees are non-refundable once work has begun.

10. Client Responsibilities

  • The Client is responsible for providing accurate information and current contact details.
  • The Client is responsible for ensuring offers, discounts, and coupon details are correct.
  • The Client is responsible for complying with all applicable laws, rules, and advertising requirements.
  • Bow is not responsible for errors supplied by the Client.

11. Right to Refuse or Remove Service

  • Bow reserves the right to refuse, suspend, or remove any advertisement at any time.
  • This includes concerns involving legality, complaints, safety, reputation, misrepresentation, or conflict with business values.
  • Removal for violation of these terms may occur without refund.

12. Limitation of Liability

  • Bow is not liable for indirect, incidental, special, or consequential damages.
  • Bow is not responsible for lost profits, lost opportunities, or business losses.
  • Total liability, if any, is limited to the amount paid by the Client for the specific advertising service at issue.

13. Notices & Communication

Important updates, service notices, pricing changes, approvals, and account communication may be provided through email, phone, invoice notes, direct message, or website notice. The Client is responsible for keeping contact information current and checking provided communication methods.

14. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Tennessee, without regard to conflict of law principles.
